1. Scope

These General Terms and Conditions (GTC) apply to all contracts, services and offers of Job Join UG (limited liability), hereinafter referred to as the “Provider”, in connection with the online platform [job-join-europe.de] as well as the associated placement, information and support services. Mandatory statutory consumer rights remain unaffected.
The GTC apply to all registered user groups:

  • Job seekers (consumers),
  • Employers (companies domiciled in the EU),
  • External employment agencies (companies domiciled in the EU),
  • Visa agents (local partners in the applicants’ country of origin).

In addition to these General Terms and Conditions, the respective Terms of Use applicable to the relevant user group (job seekers, employers, external employment agencies, visa agents) apply to the use of the platform and the associated services. These Terms of Use form part of the contract and are made available to the user prior to the conclusion of the contract in text form via a link displayed in the order process in a checkbox option (without actively ticking the box to consent to the GTC and Terms of Use, conclusion of a contract is technically not possible). In addition, immediately after the conclusion of the contract, the GTC and Terms of Use are sent by e-mail together with the order confirmation. In the case of contracts concluded outside the platform with employers, employment agencies or visa agents (e.g. by e-mail), the respective Terms of Use are provided as an attachment prior to the conclusion of the contract upon request or offer by Job Join UG.
In the event of contradictions between these GTC and the respective Terms of Use, the provisions of the Terms of Use shall take precedence.

2. Subject matter of the contract

The platform serves the purpose of digital pre-qualification and initiation of contact between international workers and European companies as well as partners in the field of employment placement and visa processing.
Use of the platform does not constitute any legal claim to an employment relationship, a specific placement, the granting of a visa or official approvals. We provide consulting & manual intermediation; no guarantee of employment, visa or official approvals.

3. Conclusion of contract and registration

Use of the platform requires prior registration in accordance with the respective user role. The user agreement is concluded by agreeing to these GTC and the respective applicable Terms of Use.
Registration or access may be refused, in particular if the participation requirements of the respective Terms of Use are not met, false information has been provided or an impermissible multiple registration exists. Decisive are also the participation and registration requirements set out in the respective Terms of Use for the individual user groups.

4. Payment terms

Payments are made in accordance with the conditions agreed in the respective Terms of Use (e.g. membership model, flat fee, individual billing). Refunds are made in accordance with statutory provisions and—where permissible—according to the specifically agreed Terms of Use. The statutory right of withdrawal remains unaffected.
In the event of non-performance within the period specified in the respective Terms of Use after conclusion of the contract, the user may withdraw from the contract and will receive a full refund of the amount paid.

There is no automatic contract renewal or debit. After expiry, the contract ends automatically; renewed participation requires a new conclusion of contract.

5. Right of withdrawal and its expiry

(1) Consumers have a statutory right of withdrawal pursuant to § 355 BGB.

(2) In the case of contracts for digital content or services that are not provided on a physical data carrier, the right of withdrawal expires pursuant to § 356 (5) BGB if the consumer:
• expressly agrees prior to the conclusion of the contract that the Provider begins performing the contractual service before the withdrawal period has expired, and
• at the same time confirms that they lose their right of withdrawal upon commencement of performance.

(3) Consent is given by actively ticking a non-preselected checkbox in the order process. Without this consent, conclusion of a contract is technically not possible.

(4) The consumer is aware that they irrevocably lose their statutory right of withdrawal upon commencement of performance of the service following their consent and confirmation.

6. Obligations of users

All users undertake:
• to provide truthful and complete information as required,
• to use the platform for its intended purpose,
• to comply with all applicable legal provisions,
• to actively cooperate in placement or project processes.

Violations may lead to blocking or deletion of the account. If the exclusion is based on a material or repeated breach of duty for which the user is responsible, the claim to reimbursement lapses.
A material breach of duty exists in particular if the user, despite being requested, provides false information, violates legal provisions or terminates the placement process without good cause (for example due to proven illness, family emergency or comparable serious circumstances).

7. Data protection

The processing of personal data is carried out in accordance with the GDPR, the BDSG and the Provider’s Privacy Policy. Users who gain access to personal data undertake to process and delete it in compliance with the GDPR and in accordance with the purpose limitation.

The Privacy Policy applicable to the use of the platform forms part of these GTC. Changes to the Privacy Policy apply only for the future and will be communicated to users in good time. In the case of material changes affecting the purposes of processing, the Provider will obtain renewed consent prior to their entry into force, insofar as this is required by law.

8. Liability

The Provider is liable in cases of intent and gross negligence as well as for damages resulting from injury to life, limb or health.
In the event of slightly negligent breach of material contractual obligations, the Provider is liable for the typical, foreseeable damage.
Liability for placement success or official decisions is excluded.
Liability for the conduct of third parties is excluded insofar as they are not subcontractors or other vicarious agents engaged by the Provider.

9. Place of jurisdiction and applicable law

German law applies. The place of jurisdiction is Augsburg, provided the customer is a merchant, a legal entity under public law or an entrepreneur.

If the customer is a consumer with their habitual residence outside the Federal Republic of Germany, German law applies with the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory provisions of the country of residence conflict with this. Regardless of this, the consumer may assert their statutory rights at their general place of jurisdiction.

10. Severability clause

Should any provision of these GTC or the respective applicable Terms of Use be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
In this case, the statutory provisions shall apply in place of the invalid or unenforceable provision.
