1. Participation requirements

Before registration, a free assessment test must be taken at www.job-join-europe.de. The result is stored in anonymized form and deleted after 48 hours

The job seeker has actively confirmed in a checkbox that they are at least 18 years old.

The test and the result are based on the job seeker’s general qualifications and were aligned by Job Join UG with basic requirements that may be necessary to assess whether a job seeker in principle has a chance of placement.

The test serves to create an internal “ranking” in our database among all job seekers. The information provided in the test also forms the filter criteria for employers and employment agencies according to their preferences.

Every test result—even a positive or above-average test result—does not constitute a percentage chance of placement and does not guarantee official recognition, receipt of job offers or successful placement.

Access to registration may be restricted if internal capacity limits are reached or if the result of the assessment test does not reach the minimum score required for successful placement. The scoring is based on criteria that may also be used by EU Member States when granting residence and/or work permits as well as when recognizing educational qualifications. There is no discrimination on the basis of nationality, gender or marital status. In some EU Member States, age limits are linked to separate minimum salaries; therefore, the job seeker’s age may influence the test result. However, the decisive factors in the scoring are in particular completed professional qualifications, duration of training, professional experience, language skills as well as basic requirements such as a valid passport or no relevant criminal convictions in the EU. Job Join UG reserves the right, in compliance with the aforementioned criteria and avoiding any discrimination, to adjust the scoring if the demand for certain occupational groups on the labor market changes. Such adjustments serve solely to increase the job seekers’ chances of placement and are made according to transparent, objective standards set by Job Join UG.

2. Registration and data processing

Upon registration, personal data is stored for 12 months, extendable to a maximum of 18 months if a free extension is made in accordance with section 3.

After the expiry of this period, the data will be completely deleted by Job Join UG.

The job seeker expressly consents that registered employers and employment agencies who had access to their personal data before the expiry of their membership may continue to contact them for a period of up to three months after the end of the membership, provided they stored or downloaded this data in advance. This contact may also take place if the job seeker is no longer listed in the Workforce Pool, but the employer or employment agency received their data during the membership. Employers and employment agencies are obliged to check no later than three months after receiving the applicant data whether the job seeker is still listed in the Workforce Pool; if this is not the case, no further contact may be made. Consent is expressly given as part of the registration process and may be revoked at any time with effect for the future. This only applies to job seekers with paid memberships, as only they are listed in the workforce pool.

3. Membership and service

The following is required for paid admission to the Workforce Pool:

  • successful assessment test,
  • consent acknowledging that the user is aware that Job Join UG cannot guarantee placement, but that by purchasing they are only admitted to the Workforce Pool where there is the possibility—but no legal claim or guarantee—of job offers and successful placement,
  • consent to the GTC and the Terms of Use,
  • consent to data protection,
  • express waiver of the right of withdrawal (in the case of immediate performance),
  • payment of the fee.
  • Membership entitles the holder to be included in the Workforce Pool for review by employers and employment agencies. The Provider cannot guarantee that every individual applicant profile will be accessed by an employer and/or employment agency during active membership or will be transmitted to them in any other way (e.g. by e-mail). Access and transmission are determined solely by the preferences and respective needs of employers and employment agencies. The Provider’s liability for the absence of accesses, contacts or placements is excluded, unless there is intent or gross negligence.

Confirmation of membership and inclusion in the Workforce Pool is made by sending the invoice by e-mail. If the customer does not receive an invoice within 14 days after conclusion of the contract and direct payment in the shop (e.g. by credit card, Google Pay, Apple Pay, PayPal), they may withdraw from the contract and will receive a full refund of the amount paid. If payment is made by bank transfer, the provisions in no. 8 paras. 6 and 7 apply.

Notice: Admission to the Workforce Pool does not create a legal claim to job offers or placement. No placement is guaranteed.

If no serious job offer corresponding to their qualification or no successful placement occurs within 12 months, the membership is automatically and completely free of charge extended by a further 6 months (to a maximum of 18 months).

The selection and transmission of suitable applicant profiles to employers with Premium Membership may be carried out by the matching algorithm mentioned on the website, by manual selection by the staff of Job Join UG or by the employer’s own search and filtering. The matching or algorithm system referred to on the website is based exclusively on the criteria and preferences manually selected by employers, employment agencies, or by Job Join (e.g., characteristics or requirements of a candidate profile). The system merely serves as a technical tool to support the presentation of potentially suitable profiles. The selection and decision regarding the creation or confirmation of matches are made solely by the respective employers, employment agencies, or by Job Join personnel acting on their behalf. No fully automated matching or purely algorithmic decision-making takes place.

4. Duties to cooperate

Job seekers undertake to actively participate in application, interview and visa processes and to provide all relevant documents lawfully.

The platform may only be used with truthful information.

5. Document management

Users can upload two types of documents in their user area:

  1. Application-relevant evidence such as university degrees, certificates or professional qualifications;
  2. Specific job offers or draft employment contracts addressed personally to them in German or English in PDF format, even if these were transmitted outside the Job Join network.

Uploading job offers or draft employment contracts for review is only permitted if there is a legitimate interest.

Application-relevant evidence is visible during active membership to activated and registered employers, external employment agencies and visa agents and may be downloaded by them to assess suitability.

Review of uploaded job offers is carried out only if they are specifically addressed to the user personally. Offers outside the Job Join network may also be uploaded.

The review by Job Join UG is informative with regard to basic fairness and comprehensibility, but does not constitute a legal assessment.

Uploading received job offers is possible without limitation during paid membership; fair use is assumed.

Responsibility for the accuracy, completeness and relevance of all uploaded content lies solely with the user. The user may only upload documents that clearly relate to their professional qualification and/or the initiation of an employment relationship and that concern them personally and name them by name.
Uploading content without the corresponding relevance may lead to exclusion from the platform.
The user is solely responsible for not uploading prohibited, copyrighted, confidential or pornographic content. The user is liable for damages resulting from the infringement of third-party rights through uploaded content, insofar as they are at fault. The user indemnifies Job Join UG from all claims.
Job Join UG does not examine the documents uploaded by the user either in terms of content or law and assumes no warranty for their authenticity, accuracy or legal admissibility.

6. Visibility and data access

Data/applicant profiles are visible only during active membership to activated employers and employment agencies.

After the end of membership, job seekers may be contacted by these contacts for up to a maximum of three months, provided the data was previously stored or downloaded.

If contact is made after this period has expired, Job Join UG requests notification by the affected user stating the name and company of the contacting party in order to be able to review and prevent a violation.

The opening and closing of the shop for the registration of new job seekers depends on internal capacities. These access restrictions relate exclusively to new admissions to the Workforce Pool. They have no effect whatsoever on the login area for employers and employment agencies and their search and contact functions. Job seekers already registered remain fully visible, and contacting them remains unrestricted. They can continue to use the login area to retake or update a assessment test without any restrictions.

7. Cost coverage by Job Join UG

Job Join UG assumes the complete handling as well as the costs for visa, residence and work permits if all of the following conditions are met:

  1. The job seeker has an active, paid membership in the Workforce Pool at the time of the job offer or receipt of the draft employment contract or, at the time of first contact, the membership had been expired for no more than three (3) months.
  2. The job seeker has received a specific job offer or a draft employment contract addressed personally to them.
  3. The employer is registered and has an active Premium Membership and has a sufficient credit quota.
  4. The job seeker has submitted the relevant job offer or draft employment contract to Job Join UG for review with email to: check.coverage@job-join.de
  5. The review has shown that all of the aforementioned conditions are met.
  6. Written confirmation of cost coverage has been issued by Job Join UG.

Further notes:

Cash payout of reimbursement of costs to the job seeker is excluded.

Job Join UG reserves the right to have the processing carried out by commissioned subcontractors (e.g. employment agencies or visa agents). For this purpose, the personal data and documents relevant to the process may be passed on. As part of a placement process, the job seeker may also be contacted by these subcontractors.

In individual cases, Job Join UG may additionally voluntarily cover the job seeker’s flight or travel insurance costs as part of a promotion.

If the job seeker receives a specific job offer or a corresponding draft employment contract addressed personally to them from a registered employer with Basic Membership, cost coverage does not generally take place. In individual cases, however, voluntary coverage by Job Join UG may take place as part of a promotion. The prerequisite for this is a prior review and written confirmation by Job Join UG after submission of the draft contract with email to: check.coverage@job-join.de. Any voluntary cost coverage is at the sole discretion of Job Join UG and does not create a legal claim for the future.

8. Payment terms

Payments are made exclusively via the payment methods specified in the online shop.

All prices are stated in euros. The exchange rates displayed on the website in other national currencies via the currency converter are for information purposes only and are based on current reference rates. The euro amount shown in the online shop is always decisive for the purchase. For payments from third countries, conversion usually takes place automatically. Any fees incurred for foreign currencies, credit card payments or international transfers are borne by the user.

If payment is made outside the shop by bank transfer or via a money transfer service provider (e.g. Western Union, Ria, MoneyGram), the user must ensure that all transfer, exchange rate and receiving fees are fully borne by them. The invoiced amount must be received in full and free of charges in the account of Job Join UG.

For bank transfers, the “OUR” option must be selected so that all fees are borne by the sender.

Payment must be made under the order number stated in the order confirmation. This must be indicated as the reference/purpose. Only in this way can the payment be correctly assigned and the membership activated.

Payment is due immediately upon receipt of the order confirmation. However, due to the possibly long transfer duration, Job Join UG accepts payments that are received in the account up to 14 days after receipt of the order confirmation. For payments by international bank transfer (e.g. SWIFT), the user should note that such payments may take up to 7 working days or longer depending on the country of origin and bank processing times. The transfer should therefore be made in good time. In the event of late receipt of payment, Job Join UG reserves the right to cancel the contract and will inform the user of this by e-mail. In this case, a refund will only be made minus all incurred bank fees.

If Job Join UG accepts a late payment, the user will receive the invoice within 14 days of receipt of payment, which counts as confirmation of participation in the Workforce Pool, by e-mail. This is deemed to be the express acceptance of the contract by Job Join UG.

In the case of refunds due to circumstances not attributable to Job Join UG, the user shall bear any bank fees incurred.

Refunds are made exclusively to a bank account that can receive SWIFT payments, unless an error lies on the part of Job Join UG.

There is no automatic renewal or recurring debit. After expiry, the contract ends automatically; renewed participation requires a new conclusion of contract.

9. Reasons for exclusion

A refund (including pro-rata) will not be made if the user no longer wishes to use the service prematurely. In this case, the user may delete their account. From this point on, they are no longer visible or contactable in the login area for potential employers and employment agencies. However, it is possible that employers or employment agencies have stored or downloaded their data before the account deletion and contact them for up to three months thereafter. If contact is made later, Job Join UG requests notification stating the company or person in order to review and prevent corresponding violations.

If the job seeker has signed an employment contract with a registered employer or through a registered employment agency and culpably terminates the placement process for the second time without relevant justification or is not reachable for more than 14 days without comprehensible reasons, and the process is therefore jeopardized or must be terminated, Job Join UG reserves the right to exclude the user from the platform. A refund of the membership fee will not be made. An ongoing process exists if a signed employment contract with a registered employer is in place and an application for a visa, work or residence permit has been submitted.

The job seeker is also obliged to provide truthful information in the test and registration. Upon request, evidence must be submitted to potential employers, employment agencies, visa agents or Job Join UG. If a placement process is terminated due to false information, the user may be excluded from the platform. No refund will be made.

10. Data protection

Users agree to GDPR-compliant and lawful processing.

Data is passed on exclusively to registered and authorized partners for the initiation or implementation of the placement process, including activated employers and employment agencies who can find the listed job seeker via the platform.

11. Right of Withdrawal

The statutory 14-day right of withdrawal pursuant to Section 355 of the German Civil Code (BGB) lapses if the service is a digital service and performance begins before the end of the withdrawal period at the user’s express request (§ 356(5) BGB).

Before submitting their contractual declaration, the user confirms that they have taken note of the withdrawal policy prior to completing the order and expressly requests that performance of the service begin immediately, and acknowledges that they lose their right of withdrawal once performance begins. Consent is given by actively ticking a non-pre-ticked checkbox during the checkout process. Without this consent, the conclusion of the contract is not technically possible.

The withdrawal policy is provided to the user after conclusion of the contract together with the order confirmation in text form (e.g., by e-mail).

Note: The service is activated without undue delay upon conclusion of the contract. Where the service begins immediately, the right of withdrawal lapses with the user’s consent pursuant to § 356(5) BGB.

12. Term and termination

No automatic contract renewal after 18 months.

An extension to 18 months only takes place if no serious job offer corresponding to their qualification or no successful placement occurs within the first 12 months.

Re-admission is only possible through re-registration.

There is no automatic contract renewal or debit. After expiry, the contract ends automatically; renewed participation requires a new conclusion of contract.

Final provision

Otherwise, the provisions of the GTC of Job Join UG (limited liability) apply.

The GTC and these Terms of Use are components of the contract and are made available to the user prior to the conclusion of the contract in text form via a link displayed in the order process in a checkbox option and are also transmitted immediately after the conclusion of the contract by e-mail together with the order confirmation.
